Jurisdiction
Portugal
Our own jurisdiction. Ventos Arqueáveis Unipessoal Lda is registered in Monção, and Portuguese law is where the platform's contract and retention rules were first built out.
The Legal Environment
Portugal is a civil law jurisdiction. Contract law sits in the Código Civil, commercial rules in the Código das Sociedades Comerciais, and EU regulation applies directly, with national law filling in where a directive leaves room. For a legal department this means two sources to track for most questions: the EU instrument and the Portuguese implementation.
In practice the friction is rarely the substantive law. It is retention periods that differ per document type, filings that must be in Portuguese, and sectoral regulators whose guidance moves faster than the statute underneath it.
What We Support Locally
Configured for Portugal out of the box, not adapted from a generic EU template.
Portuguese Contract Positions
Mandatory clauses, governing law and notice conventions as they are actually used in Portuguese agreements.
Retention by Document Type
Tax, employment, commercial and sector records each carry their own period, applied per document.
CNPD Practice
Data protection guidance tracked as a separate source from the EDPB, because the two do not always move together.
Language Handling
A Portuguese version maintained alongside the working language where filing or consumer rules require it.
Procedural Deadlines
Limitation periods and court deadlines calculated on the Portuguese calendar, including judicial holidays.
Local Counsel Review
Jurisdiction rules reviewed by Portuguese-qualified counsel before each release.
Local Requirements That Catch People Out
- Retention is driven by the underlying obligation, not by the contract — so one agreement can carry several periods at once.
- Documents filed with public bodies must be in Portuguese, which is usually discovered at filing time.
- Sectoral regulator guidance is not always published alongside the EU instrument it implements.
- Judicial holidays shift procedural deadlines, and a calendar that ignores them will be wrong twice a year.
Frequently Asked Questions
What companies ask before contracting under Portuguese law.
The Comissão Nacional de Proteção de Dados (CNPD) supervises data protection in Portugal. Sectoral regulators — Banco de Portugal, ASF, ANACOM — apply on top of it depending on the activity.
Not in general between businesses: parties are free to choose the language. Consumer contracts, employment documents and anything filed with a public body are the practical exceptions, and the platform keeps a Portuguese version alongside the working one.
Yes. Portugal applies eIDAS, so qualified electronic signatures carry the same legal effect as handwritten ones. Simple and advanced signatures are admissible but weigh differently in evidence, which is why the platform records which type was used.
It depends on the obligation behind the document rather than the contract itself — tax records, employment files and financial-sector records each carry their own period. Retention is configured per document type, not globally.
